Terms of Use

The Price Kaki App is a crowdsourcing application owned and operated by the Consumers Association of Singapore (“CASE”, “we”, “us” or “our”). By using the Price Kaki App (as defined below), you agree that you have read, understood and agreed with this terms and conditions (“Terms and Conditions”).

1.Disclaimer

Data contained on the Price Kaki App are sourced from the Participating Outlets and crowdsourced from account holders, and are for information purposes only. While CASE takes reasonable efforts to ensure the accuracy of the Data, CASE does not warrant that the Data are accurate. Accordingly, CASE shall not be responsible for any losses suffered, directly or indirectly as a result of the Data.

2.Definitions

The following terms shall have the following respective meanings:

“Data” means any price updates or updates on the Participating Outlets, and the relevant photographs uploaded by the account holder on the Price Kaki App.

“Merchant” means a third party who supplies or provides the goods and/or services for the Rewards.

“Participating Outlets” means all supermarkets and selected NEA hawker-food stalls across Singapore.

“Product” means any grocery or household product displayed on the Price Kaki App and available at the supermarkets, or any item displayed on the Price Kaki App and available at the hawker-food stalls.

“Register” means the process of an account holder creating a registered account on the Price Kaki App.

“Reward(s)” means in-app electronic-vouchers redeemable by the account holder through the Price Kaki App.

3.Use of the Price Kaki App

You shall not misuse the Price Kaki App. You confirm that all the Data which you provide shall be true and accurate. You shall not commit or encourage a criminal offence, transmit or distribute a virus including but not limited to Trojan horse, worm, logic bomb or post any other materials on the Price Kaki App which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene, corrupt data, cause annoyance other users or infringe upon the rights of any other person’s proprietary right. We reserve the right, at our absolute discretion, to prevent you from using the Price Kaki App (or any part thereof).

To use the Price Kaki App, you will require internet connectivity and appropriate telecommunication links. CASE shall not be liable for any such charges, including roaming data charges, telephone costs, telecommunications costs or other costs that you may incur in connection with the same. The Price Kaki App may be subject to limitations, delays and other problems inherent in the use of the internet and electronic communications including the device used by you.

The Price Kaki App may contain links to other websites. CASE assumes no responsibility for the content and of any external sites, and we accept no responsibility for any loss or damage that may arise from your use of them.

4.Account Registration

A Singapore registered mobile number is required to Register for an account on the Price Kaki App and each consumer shall only create one registered account.

You are not required to Register to use the Price Kaki App. However, you must Register to receive price alerts, to submit price and/or promotional Data, to earn rank points and to claim and redeem Rewards.

5.Game Rules and the Submission of Data

In the event that the retail or promotional price displayed on the Price Kaki App differs from that in the Participating Outlets, you may use a registered account to submit Data on the Price Kaki App, together with a photo of the Product, the price tag and all relevant information for verification. You may also report any permanent or temporary closures of the Participating Outlets via the Price Kaki App. You may only update the Data of a Product in a single Participating Outlet once a day, and are limited to 200 Data updates per day.

Rank points may be issued for each daily log-in, and for each verified submission of Data. Your rank points will be automatically updated onto the Price Kaki App. Only verified rank points would be calculated towards your final ranking for each season. CASE reserves the right to award rank points to registered accounts.

You may earn Rewards on the Price Kaki App depending on your ranking after every season. The value of the Rewards is dependent on your rank on the season leader board. A season runs every two weeks and Rewards will be awarded to qualifying registered accounts after every season. The ranking for each season would be finalised within a week from the end of each season. CASE reserves the right to discontinue a season without prior notice to you.

6.Redemption of Rewards

Once the rankings have been finalised, all qualifying registered accounts will receive an in-app notification to claim the Rewards. All Rewards must be claimed on the Price Kaki App within 1 month (or the date stipulated in the Price Kaki App). The selected Rewards would be stored in your Price Kaki App account, and would remain valid for use for a period of 3 months. Any unclaimed or unused Rewards shall be forfeited, and no requests for replacement or refund shall be entertained.

The list and details of available Rewards would be accessible on the Price Kaki App. The list of Rewards may be revised by us from time to time without prior notice and all claims and redemptions of Rewards are subject to availability and any terms and conditions as may be stipulated by the respective participating Merchant.

All individuals are only entitled to 1 Reward per season. CASE reserves the right to withhold your Rewards if you have been found to have claimed more than 1 Reward.

Any Rewards once claimed or redeemed are not refundable, nor exchangeable for cash or for any other Rewards. Reproduction, misuse, tampering or forgery of Rewards is prohibited. Neither CASE, the Merchant nor service providers are responsible for lost or stolen Rewards or reward reference numbers.

7.Termination / Deactivating / Suspension of Account

Your account on the Price Kaki App may be terminated / suspended by us if you:

• use the Price Kaki App in contravention of this Terms and Conditions, and the relevant game rules displayed on the Price Kaki App;
• have been found to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple registration accounts, or if a foreign user pretends to be a local user, or disrupts the Price Kaki App or the other users in any way; and
• are suspected to have committed fraud, or behave maliciously by repeatedly submitting incorrect Data on the Price Kaki App.

Termination, suspension or deactivation of your account, either by us or yourself, shall be deemed as termination of your participation in the respective seasons, and the deactivation of all Services.

8.Intellectual Property Ownership

All intellectual property rights (including all copyright, patents, trademarks, service marks, trade names, designs, whether registered or unregistered) in the Price Kaki App, information and Data contents on the Price Kaki App, any database operated by us and all the website design, text and graphics, software, photos, and their selection and arrangement, and all software compilations, underlying source code and software (including applets and scripts) shall remain our sole and exclusive property (or that of our licensors). Other product and company names mentioned on the Price Kaki App are the trademarks or registered trademarks of their respective owners.

9.Data Privacy & Personal Data Protection Policy

CASE takes data privacy seriously. You agree and consent to CASE collecting, using, processing and disclosing your Personal Data to facilitate the use, process and validation of the Price Kaki App in accordance with the Personal Data Protection Act, and as further described in our Privacy Policy.

10.Indemnification & Limitation of Liability

By agreeing to this Terms and Conditions upon using the Price Kaki App, you agree that you shall defend, indemnify and hold CASE and its officers, representative, directors, members, employees and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses arising out of or in connection with (a) your use or misuse of the Price Kaki App, (b) your violation or breach of any of this Terms and Conditions or any applicable law or regulation, whether or not referenced herein, or (c) your violation of any rights of any third party.

11.Miscellaneous

The availability of the Price Kaki App is strictly for your non-commercial use only. You undertake not to authorise others to use your identity (e.g. mobile number / account), and you may not assign or otherwise transfer your account to any other person or entity without our prior written consent.

In using the Price Kaki App, you may enter into correspondence with, or participate in promotions of the Merchants, advertisers or sponsors showing their goods and/or services through the Price Kaki App. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between you and the third-party. CASE does not endorse any applications or sites on the Internet that are linked through the Price Kaki App, and in no event shall CASE be responsible for any content, products, services or other materials on or available from such sites or such third-parties.

12.General

This Agreement shall be governed by Singapore law, and all disputes shall be subject to the jurisdiction of the Singapore Courts.

If any provision of this Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. This shall, without limitation, also apply to the applicable law and jurisdiction as stipulated above.

The failure of CASE to enforce any right or provision in this Terms and Conditions does not constitute a waiver of such right or provision unless acknowledged and agreed to by CASE in writing.

You hereby agree that CASE is entitled to terminate this Terms and Conditions immediately in the event that you are found to be in breach of any of the terms stipulated in this Terms and Conditions. For the avoidance of doubt, the termination of this Terms and Conditions shall not require CASE to compensate, reimburse or cover any cost incurred by you.
